By accessing or using the BloomHand platform ("Service") operated by BloomHand ("we", "us", or "our") at bloomhand.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including community organizers, community members, and visitors who access a community board via a community code or direct link.
You must be at least 13 years of age to use the Service. If you are under the age of majority in your province or territory of residence, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
BloomHand is a web-based community board platform. Organizers create communities and post needs (volunteer sign-ups, events, announcements). Members view the board and sign up to help by tapping "I'm In." The Service is designed for churches, PTAs, neighbourhood groups, and similar organizations.
The Service performs certain actions automatically on your behalf, including publishing scheduled posts, advancing recurring needs, sending opt-in reminders and notifications, and expiring subscriptions. These automated processes are part of the normal operation of the Service.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
The Service uses passwordless authentication. You log in via a magic link sent to your email address. You are responsible for maintaining access to the email address associated with your account and for all activity that occurs under your account.
Community boards may be accessed by entering a community code or using a direct link shared by an organizer. Community codes and links are intended for distribution to the community's members. If you receive a code or link, you should not redistribute it beyond the intended audience without the organizer's permission.
Email communications from BloomHand. By using the Service, you may receive transactional emails from us, including magic-link authentication emails, sign-up confirmations, event reminders, waitlist notifications, and weekly digest summaries. You may also receive announcement emails sent by your community's organizers through the platform. You can manage your notification preferences in your account settings. Transactional emails necessary for the operation of the Service (such as authentication emails) cannot be opted out of while your account is active.
If you create or manage a community ("Organizer"), you are responsible for:
Member email visibility. When a user joins your community, the community owner can see that member's email address for the purposes of identity verification and community management. Organizers (non-owner administrators) and other members cannot see email addresses. You must not use member email addresses for any purpose unrelated to your community, including unsolicited marketing, sale to third parties, or sharing with anyone outside your organization.
Email communications. The Service allows organizers to send announcement emails and other notifications to community members through the platform. These communications must be relevant to your community's purpose. You must not use the Service to send spam, promotional content for unrelated products, or any communication that violates applicable anti-spam laws, including Canada's Anti-Spam Legislation (CASL).
Data exports. Premium communities may export community data (member lists, activity reports). Exported data is subject to the same responsibilities outlined above. You are solely responsible for how you store, use, and protect any data you export from the Service, including compliance with applicable privacy laws.
We do not pre-screen content but reserve the right to remove content or suspend communities that violate these Terms.
You agree not to:
You retain ownership of any content you submit to the Service, including post descriptions, display names, and sign-up notes ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, host, display, and distribute that content solely for the purpose of operating and providing the Service. This licence continues for content already distributed until it is deleted from the Service.
Sign-up information (your display name and optional note) is visible to other members of the same community board. Your email address is never displayed to other members.
You represent that you have the right to post any User Content you submit and that it does not violate the rights of any third party. We may remove any User Content that violates these Terms or that we reasonably believe is harmful, at our sole discretion.
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BloomHand. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
The Service may contain links to third-party websites or services that are not owned or controlled by BloomHand. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that BloomHand is not responsible or liable for any damage or loss caused by the use of any such third-party content or services.
BloomHand offers a free tier and may offer paid plans with additional features. If you purchase a paid plan, you agree to pay all applicable fees. Paid subscriptions renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.
We may add, modify, or remove features from any plan — including the free tier — at any time. Where practicable, we will provide advance notice of material changes to plan features. Continued use of the Service after such changes constitutes acceptance.
Payment is processed by Stripe. Your use of Stripe's services is subject to Stripe's terms and privacy policy.
Sponsorship and gift codes. A third party ("Sponsor") may purchase a Premium subscription on behalf of a community. Gift codes are non-refundable once redeemed. If a community already has an active Premium subscription, redeeming a gift code extends the existing subscription by the gifted duration. Sponsoring a community does not grant the Sponsor any organizer or owner rights within that community.
Downgrade behaviour. If you cancel a paid plan or allow it to expire, your community and its data are preserved. Features exclusive to the paid plan become unavailable — for example, additional boards become read-only and Premium-only tools are disabled. You may re-subscribe at any time to restore access.
You may stop using the Service at any time. Organizers may delete their community at any time through the Service. You may request deletion of your account by contacting us.
We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or if we reasonably believe your conduct is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
Upon termination or account deletion, your personal data will be handled in accordance with our Privacy Policy. Sections 7 (User Content licence for already-distributed content), 10 (Fees), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 15 (Governing Law) survive termination.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content on the Service is accurate or reliable. We are not responsible for the actions, content, or conduct of any user or community on the platform.
To the maximum extent permitted by applicable law, BloomHand and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty Canadian dollars (CAD $50).
You agree to defend, indemnify, and hold harmless BloomHand and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any User Content you submit.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Before initiating any legal proceeding, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, it shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Where possible, we will provide at least 15 days' notice before material changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BloomHand regarding your use of the Service and supersede any prior agreements.
